SwyftMealz is dedicated to providing a fast, reliable, and transparent food delivery marketplace. By using our platform, you agree to comply with our terms regarding user accounts, order placement, secure payments, and delivery procedures.

Introduction and Acceptance of Terms

Welcome to SwyftMealz. By accessing, downloading, or using our website, mobile applications, or any of our food delivery services, you agree to be bound by this User Agreement and our Terms and Conditions. If you do not agree to these terms, you must immediately cease using our platform. This agreement forms a legally binding contract between you and SwyftMealz and applies to all users of the platform, including Customers, Vendors (Restaurants), and Riders (Delivery Partners).

We reserve the right to modify or update this User Agreement at any time. Any changes will be posted on this page with an updated 'Last updated' date. Your continued use of the SwyftMealz platform after any such modifications constitutes your acceptance of the revised terms. We encourage you to review this agreement periodically to stay informed of any updates.

User Accounts and Eligibility

To access most features of the SwyftMealz platform, you must register and maintain an active personal user account. You agree to provide accurate, current, and complete information during the registration process and to keep your account details updated. You are solely responsible for maintaining the confidentiality of your account credentials, including your password or OTP authentication codes, and for all activities that occur under your account.

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account and place orders on SwyftMealz. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. SwyftMealz will not be liable for any loss or damage arising from your failure to comply with these security obligations.

Ordering, Pricing, and Delivery

Customers may place orders for food, beverages, and other items offered by Vendors on our platform. All orders are subject to acceptance by the Vendor and item availability. Prices for menu items are set by the respective Vendors and may differ from dine-in prices. SwyftMealz charges delivery fees, service fees, and applicable taxes, all of which are clearly displayed on the checkout screen before you complete your order.

Delivery times provided at checkout are estimates only and are not guaranteed. While Riders make every reasonable effort to deliver your order within the estimated window, factors such as traffic, weather, and preparation delays may affect delivery times. You are responsible for providing an accurate delivery address and being available to receive the order from the Rider. If a delivery fails due to an incorrect address or your unavailability, you may still be charged the full amount of the order.

Payments, Cancellations, and Refunds

All payments for orders placed through SwyftMealz must be made using our supported secure payment methods, processed by our trusted partners (including Paystack and Stripe). Once an order has been accepted by a Vendor, it enters preparation and cannot be cancelled or modified by the Customer. You agree to pay all charges incurred in connection with your order, including all applicable fees and taxes.

Refunds, credits, or adjustments may be issued at our sole discretion in cases of incorrect items, missing items, significant delivery delays, or food quality issues. To be eligible for a refund or credit, you must report the issue to our customer support team within a reasonable timeframe (typically within 2 hours of delivery) and provide supporting evidence, such as photos of the received items, if requested.

Vendor and Rider Responsibilities

SwyftMealz operates as a three-sided marketplace matching Customers, independent Vendors, and independent Riders. Vendors are solely responsible for the preparation, quality, packaging, and safety of all food and beverage items ordered. Riders are independent contractors responsible for the safe, timely, and sanitary transport of orders from the Vendor's location to the Customer's delivery address.

SwyftMealz does not prepare food, operate restaurants, or directly employ Riders. Consequently, to the maximum extent permitted by law, SwyftMealz disclaims all liability arising from the preparation, quality, safety, or delivery of the items, as well as any acts or omissions of Vendors or Riders. We do, however, maintain strict standards of service and will take appropriate action against partners who fail to meet our quality guidelines.

Limitation of Liability and Indemnification

The SwyftMealz platform is provided on an 'as is' and 'as available' basis without warranties of any kind, either express or implied. To the maximum extent permitted by law, SwyftMealz, its affiliates, directors, employees, and partners shall not be liable for any indirect, incidental, special, exemplary, or consequential damages, including lost profits, lost data, or personal injury, arising out of or in connection with your use of our platform or services.

You agree to indemnify, defend, and hold harmless SwyftMealz and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the platform, your violation of this User Agreement, or your violation of any third-party rights, including those of Vendors or Riders.
